If I am self employed can I obtain a Standard or Enhanced Disclosure?

As a self employed person it is not possible to obtain a Standard or Enhanced Disclosure for yourself.  Section 122 (1) of Part V the Police Act 1997 establishes a Code of Practice and the Code stipulates the conditions which a person must meet before he or she can register to apply for Standard or Enhanced Disclosures.  Clause 13 of the Explanatory Guide on the Code of Practice details the conditions which require to be met.

To obtain a Standard or Enhanced Disclosure, the self employed individual would need to go through an organisation who acts as an Umbrella Body.

If the post is not an exempt position as laid down in the Rehabilitation of Offenders Act 1974 (Exclusions and Exceptions) (Scotland) Order 2003 (as amended) then you could apply for a Basic Disclosure, which is available online.
