Is foreign conviction information included in Disclosures?

Disclosure Scotland works under UK legislation and has no jurisdiction to obtain criminal history information from other countries.  Not all foreign countries have a system of recording information.  If a UK resident is convicted overseas and the authorities in that country notifies a UK Police Force then that conviction will be recorded and will be available for disclosure.  For Registered Bodies dealing with overseas applicants we suggest you put the onus on the individual to provide details of their criminal history from their home country.

To assist you in this matter, you may wish to check the undernoted websites/documents.  You are advised, however, that Disclosure Scotland has had no input to the production of the websites or documents being linked to and we are not responsible for the contents of these sites/documents.

  • Produced by CRB (website)
  • Produced by Australian Government (PDF document)(whilst this provides advice on what information is required by Australian authorities for those wishing to emigrate to Australia, it also provides information on the types of criminal record checks which are available from various countries and which you may request from your applicants)
  • Overseas criminal record checks - a risk assessment guidance document produced by the Scottish Government's Health Workforce Directorate (Word Document)

Work is currently being undertaken on how foreign conviction information can be accessed.  This is one of the recommendations from the Bichard Inquiry Report.  The Bichard Inquiry was set up by the Government following the Soham murders in 2002.
